Dog Mauling Case Opinion
After watching the case study on the San Francisco dog mauling, I was actually pretty shocked with the outcome. It seemed like the whole class thought that the judge was right to appeal the charge of 2nd degree murder. If I were the judge I wouldn't have overturned the appeal. I think that Marjorie was guilty of 2nd degree murder. The fact that she was helping breed and raise guard and attack dogs proves to me that she had the intention of having her dogs hurt someone. As a dog owner myself, I feel that it is the owner's responsibility to keep their dog away from people that he/she could harm. Also, I think that this accident could have been easily avoided if the dogs had been muzzled.

I do not think Marjorie was guilty of second degree murder. Although I think she was negligent and guilty of involuntary manslaughter, I do not think she ever intended for her dogs to kill someone. I agree that it is the owner's responsibility to keep their dogs away from people considering that they could potentially endanger them, so because of that I think she is very guilty of negligence.

ReplyDeleteI agree with you Maddie, I think that the judge should not have appealed the second degree murder charge. The fact that the couple claimed they didn't know their dogs were dangerous was beyond me, after 30 incidents, the owners knew that their dogs were a danger to society. It was definitely an avoidable situation, but what really stumps me is why a person would want animals that are dangerous, because at any given day the dogs could have easily turned on one of their owners. Then maybe they would feel some remorse about it.
